AN ORDINANCE

Amending title 9 of The Philadelphia Code, entitled “Regulation of Businesses, Trades and Professions,” by requiring any establishment that sells alcoholic beverages for consumption on or off the premises to install, maintain and use electronic equipment that scans identification cards and displays the age of the person as indicated on the card; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 9 of The Philadelphia Code is hereby amended to read as follows:

TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS

CHAPTER 9-2400. SALES OF ALCOHOL; VERIFICATION OF AGE

§9-2401. Definitions.

(1) Electronic age verification equipment.  Equipment that electronically scans an identification card and displays the age of the person as indicated on the card.

(2) Liquor sales establishment.  An establishment that sells alcoholic beverages at retail for consumption on or off the premises.

§9-2402. Required electronic age verification equipment.

(1) A liquor sales establishment shall install and maintain electronic age verification equipment.  Such equipment shall meet the requirement set forth in regulations to be promulgated by the Department.

(2) A liquor sales establishment shall use electronic age verification equipment to verify the age of any person from whom the establishment requests identification.
